This Policy applies to personal data we may collect from you, or that you provide to us, through or in connection with our platform – “Creator”: https://creator.automatedcreative.net/ (the "Platform") and the services we provide in the context of this Platform (the “Services”).

We will only collect and process information about you in accordance with this Policy and we will only use information collected about you in accordance with applicable data protection laws including without limitation the Data Protection Act 2018 and the UK GDPR (as defined in the Data Protection Act 2018). Where we decide the purpose or means for the processing of the personal data that you provide when using our Services, we are the “data controller”.

1. What Data We Collect

1.1 If you create an Account, we will process the following data:

  1. Your first and last name; and
  2. Your email Address

1.2 We process the following data when you arrive on our Platform and use our Platform:

  1. IP address;
  2. Location (country and city);
  3. Country of install and language;
  4. Unique device ID, hardware manufacturer and model;
  5. Operating system and version;
  6. Relevant Account and version; and
  7. ‘Events’ related to the Platform stream, such as navigation, form submits & errors and choices/selections within the Services, interactions with the Platform; and
  8. Any of your content you choose to submit via the Platform.

1.3 Via your Account, you also have the possibility to integrate and link your social media accounts and by doing so agree that we shall have access to the following data from such social media accounts (including without limitation Meta, Twitter, TikTok, Snapchat, Pinterest, LinkedIn, YouTube, Google Ads):

  1. Your full name;
  2. Your user ID;
  3. Your account log in details;
  4. Your profile picture;
  5. Your email address; and
  1. Any information relating to the advertising content available on such accounts.

1.2 We process the following data which we collect at trade shows, conferences and other industry events and which we receive from selected data brokers where the data has been collected lawfully for business-to-business direct marketing purposes:

  1. Your full name;
  2. Your company name/job title/position/department;
  3. Your business address;
  4. Your business email address;
  5. Your business phone number;
  6. Communication data.

2. How Do We Use Your Data?

2.1 Services. We will use your data to provide the services to you as set out in our Platform User Terms and Conditions.

2.2 Platform support / enquiry information. We process your data in pursuit of our legitimate interests in responding to your enquiry and to improve our services (such as where you notify us of a problem or a Platform issue).

2.3 Improvements to our services. We may collect your data so that we can understand usage of our Platform, analyse and improve our Platform and develop new Services or new parts thereof. In many cases the data would be aggregated and/or anonymised so that it would not identify you. To the extent this data includes your personal data, we rely upon your prior consent before processing it.

2.4 Newsletters, updates and marketing messages. To the extent you consent to receive or where we have a legitimate interest to send you direct marketing communication, such as newsletters and updates, we may process your data to make suggestions and recommendations to you and users of the Platform about: (a) our services, and (b) to give you information and news from time to time.

3. Your Rights In Relation To Your Personal Data

3.1 You have certain rights over the way we process personal data relating to you. We aim to comply without undue delay, and within one month at the latest, in response to any requests submitted by you to us:

  • for a copy of personal data we are processing about you and/or to have inaccuracies corrected;
  • to restrict, stop processing, or to delete your personal data;
  • for a machine-readable copy of your personal data, which you can use with another service provider. Where it is technically feasible, you can ask us to send this information directly to another provider if you prefer; and

3.2 To make a request in relation to any of the aforementioned rights, please send your request to data@automatedcreative.net.

3.3 You may request deletion of your personal data by deleting your Account by sending an e-mail to: data@automatedcreative.net. You can also decide to remove some of your personal data via your Account. Within three (3) working days of your Account deletion, we shall delete your personal data we have on file except if we are required to keep any data for a certain period of time under applicable laws.

3.4 For data processing activities for which we rely upon your consent, you can withdraw your consent at any time by contacting us at: data@automatedcreative.net or, where applicable, by using the unsubscribe link included in the marketing messages we send.

3.5 For data processing activities for which we rely upon our legitimate interests, including direct marketing purposes, you can object to the processing of your data at any time by contacting us at: data@automatedcreative.net or by using the opt‑out link provided in our marketing emails.

4. Third Parties We Share Your Data With

4.1 We will share your personal data with third parties only in the ways described in this Policy.

4.2 Analytics. We process your personal data to understand how visitors use our Platform and to compile statistical reports regarding that activity (for example, your IP address is used to approximate the country from which you access our Platform, and we aggregate this information together so we know that, for example, most of the visitors to our Platform are in England). In many cases the data would be aggregated and/or anonymised so that it would not identify you. To the extent this data includes your personal data, we rely upon your prior consent before processing it. You can withdraw your consent by notifying us at any time. 4.3 Government authorities. We may disclose your personal data to the extent that we are required to do so by law (which may include to government bodies and law enforcement agencies); in connection with any legal proceedings or prospective legal proceedings; and to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention).

4.4 Potential acquirers or investors. If we are involved in a merger, acquisition, or sale of all or a portion of our business or assets, the personal data we hold may be included as part of that sale, in which case you will be notified via email, your account and/or a prominent notice on the Platform of any changes in ownership or use of your personal data, as well as any choices you may have.

4.5 Enforcement. We may also disclose your personal information to third parties to enforce or apply the terms of agreements, to investigate potential breaches, or to protect the rights, property or safety of us, our personnel or Account holders, or others.

4.6 We only permit our suppliers and subcontractors to process your personal data for specified purposes and in accordance with our instructions. All our third-party service providers are required to take appropriate security measures to protect your personal data.

4.7 Digital Marketing Service Providers. We periodically appoint digital marketing agents to conduct marketing activity on our behalf. We may share limited information with our data brokers for the sole purpose of supporting dataquality and accuracy measures, such as ensuring that information supplied to us is not duplicated or inconsistent. Such activity may result in the compliant processing of personal information and is carried out strictly under our instructions and in accordance with a Data Processing Agreement.
